Privacy policy

1. Controller

The controller is By Enki, a creative direction, design and digital strategy studio operating from Santo Domingo, Distrito Nacional, Dominican Republic.

2. Data we collect

This site has no customer database of its own. The only personal data we receive is what you choose to send:

• ◆ Email form: name, service of interest and message. Opens in your mail client (mailto) to hello@byenki.com.
• ◆ Brief form: project name, stage and message. Sent via WhatsApp (Meta Platforms).
• ◆ Quote tool: the contact details you enter to request a quote, via the same email or WhatsApp channel.

3. Purpose

We use that data only to answer you, quote, or start a project. We do not sell it, we do not share it with third parties for advertising, and we do not build advertising profiles.

4. Legal basis

Processing is based on your consent when you submit a form (Law 172-13) and, where applicable, on pre-contractual steps at your request.

5. Recipients and third parties

Besides By Enki, the following may be involved:

• ◆ Your own email provider, if you use the mailto form.
• ◆ WhatsApp / Meta Platforms, if you use the brief or the WhatsApp button.
• ◆ Cloudflare, which hosts the site and may apply technical security measures.
• ◆ Google Tag Manager, if the measurement container is active. The container referenced in the code is currently unpublished; if it is restored, Google may process technical identifiers under its own policy.

6. Retention

We do not store your data on our own server. Messages that arrive by email or WhatsApp are kept as long as needed to help you and, if there is a commercial relationship, for as long as Dominican law requires.

7. Your rights

You may request access, rectification, erasure or objection, and you may withdraw consent, by writing to hello@byenki.com. We will reply within a reasonable time under Law 172-13.

8. Security and minors

The site is served over HTTPS. It is not directed at anyone under 18. If you are a parent or guardian and believe a minor has sent us data, write so we can delete it.

9. Changes

If this policy changes in a material way, we will update the date on this page. Continued use of the site after that date means you have read the current version.
